Welcome to estanciatanama.org. This website is operated by Estancia Tanamá Inc., the nonprofit organization behind Estancia Tanamá Animal Sanctuary (“Estancia Tanamá,” “we,” “us,” or “our”).

These Terms of Service (“Terms”) govern your access to and use of estanciatanama.org and its related pages, forms, donation tools, online store, content, and services collectively referred to as the “Site.”

By accessing or using the Site, making a donation, submitting a form, or placing an order, you agree to these Terms and our Privacy Policy. If you do not agree, please do not use the Site.

Eligibility

You must be legally capable of agreeing to these Terms. If you are under the age of majority where you live, you may use the Site only with the permission and supervision of a parent or legal guardian.

Acceptable Use of the Site

You may use the Site for lawful, personal, and noncommercial purposes, including learning about our mission, supporting our programs, submitting an inquiry, making a donation, or purchasing merchandise.

You agree not to:

Use the Site in violation of any applicable law or regulation;
Attempt to gain unauthorized access to the Site, its servers, accounts, or related systems;
Interfere with the Site’s operation, performance, or security;
Introduce viruses, malicious code, or other harmful technology;
Use automated systems to scrape, copy, or collect Site content without permission;
Submit false, misleading, abusive, unlawful, or fraudulent information;
Impersonate another person or misrepresent your relationship with any person or organization; or
Use the Site or its content in a way that harms Estancia Tanamá, the animals in our care, our supporters, volunteers, staff, or community.

We may restrict or terminate access to the Site when we reasonably believe these Terms have been violated.

Donations

Donations made through the Site are voluntary and support the charitable mission and work of Estancia Tanamá Animal Sanctuary.

Estancia Tanamá Inc. is recognized as a tax-exempt nonprofit organization under Section 501(c)(3) of the Internal Revenue Code. Donations may be tax-deductible to the extent permitted by applicable law. Your individual eligibility for a deduction depends on your circumstances, and you should consult a qualified tax professional for advice.

Donations are processed through third-party payment providers. By submitting a donation, you authorize the applicable payment provider to charge the payment method you select.

Donation Refunds

Donations are generally final and non-refundable. If you believe a donation was made in error, processed more than once, made without authorization, or charged in an incorrect amount, contact us promptly at informacion@estanciatanama.org.

We will review the request in good faith, but submitting a request does not guarantee that a refund will be issued. Refunds will be provided when required by applicable law.

Merchandise and Orders

We may offer clothing, accessories, and other merchandise for sale through the Site.

We make reasonable efforts to display product descriptions, images, colors, sizes, availability, and prices accurately. However:

Colors may appear differently depending on your screen or device;
Product images may be for illustrative purposes;
Measurements and product details may vary slightly;
Typographical, pricing, or description errors may occur; and
Products may be changed or discontinued without notice.

All orders are subject to acceptance and availability. We reserve the right to limit quantities or refuse or cancel an order because of product availability, suspected fraud, payment issues, pricing errors, or other reasonable circumstances.

If we cancel an order after payment has been processed, we will issue a refund for the canceled portion of the order.

Purchasing merchandise is generally not considered a charitable donation and is not tax-deductible unless we expressly state otherwise in writing.

Pricing and Payment

Unless otherwise stated, prices on the Site are listed in U.S. dollars.

Prices may change without notice. The price charged will be the price displayed at checkout when your order is submitted, subject to the correction of obvious pricing or technical errors.

You agree to pay the full amount displayed at checkout, including applicable shipping charges and taxes.

Payments are processed by third-party payment providers. By placing an order, you authorize the applicable provider to charge your selected payment method. We do not guarantee that every payment method will be accepted or available at all times.

Shipping and Delivery

We ship only to destinations and addresses accepted through the Site’s checkout system.

Shipping costs and available delivery options will be displayed at checkout when available. Estimated processing, shipping, and delivery dates are estimates and are not guaranteed unless expressly stated otherwise.

We will make reasonable efforts to process and ship orders within the timeframe communicated at checkout or in your order confirmation. Delivery may be affected by carrier delays, weather, emergencies, customs processing, incorrect addresses, or other circumstances outside our reasonable control.

If we are unable to ship your order within the applicable timeframe, we may contact you regarding the delay, offer an updated shipping estimate, or provide a cancellation and refund option as required by applicable law.

You are responsible for providing a complete and accurate shipping address. Additional shipping costs caused by an incorrect or incomplete address may be the customer’s responsibility.

Returns, Refunds, and Exchanges

Many of our products may be printed or made to order. Unless a different policy is displayed on the applicable product page, we generally do not accept returns or exchanges because of:

A change of mind;
An incorrect size or color selected by the customer;
Personal preference; or
Normal variations in color or appearance.

If an item arrives damaged, defective, misprinted, or different from what you ordered, contact us at informacion@estanciatanama.org within 14 days of delivery.

Please include:

Your name;
Your order number;
A description of the problem; and
Clear photographs showing the item and the damage, defect, or error.

After reviewing the request, we may provide a replacement, refund, or other appropriate resolution. We may require the item to be returned before issuing a replacement or refund.

Original shipping charges are generally non-refundable unless the return resulted from an error on our part or applicable law requires otherwise.

Nothing in this section limits any consumer rights that cannot legally be waived.

Taxes

Applicable sales, use, or other taxes may be calculated and displayed during checkout based on the order and shipping destination.

You are responsible for any taxes, duties, customs charges, or similar fees that are not collected through the Site but are imposed by an applicable government or authority.

Volunteer, Foster, Adoption, and Other Inquiries

The Site may allow you to submit volunteer, foster, adoption, surrender, partnership, or general contact inquiries.

Submitting a form does not:

Guarantee that you will be accepted as a volunteer or foster;
Guarantee the adoption, surrender, rescue, or placement of an animal;
Reserve a particular animal;
Create an employment, volunteer, foster, adoption, or contractual relationship; or
Require Estancia Tanamá to approve or respond to the request.

We review inquiries based on our available resources, eligibility requirements, animal welfare considerations, and organizational needs. We may request additional information, conduct interviews, request references, perform home or veterinary checks, or require separate agreements before approving participation or placement.

Any foster, volunteer, adoption, surrender, transportation, or similar arrangement may be governed by a separate written agreement. If there is a conflict between these Terms and a separate signed agreement, the signed agreement will control for that arrangement.

Animal information, including age, breed, health, temperament, and availability, is based on the information reasonably available to us and may change.

Information and Content You Submit

When you submit information through the Site, you represent that:

The information is accurate to the best of your knowledge;
You have the right to provide it;
It does not violate another person’s rights; and
It is not unlawful, threatening, abusive, fraudulent, or misleading.

You authorize us to review and use submitted information as reasonably necessary to respond to your inquiry, process your donation or order, evaluate an application, provide requested services, protect animal welfare, maintain our records, and operate the organization.

Our collection and handling of personal information is further described in our Privacy Policy.

Submitting photographs, videos, testimonials, stories, or other creative content does not automatically grant us permission to publish that material publicly unless you have provided separate permission or the context of the submission clearly authorizes publication.

Intellectual Property

The Site and its content—including its text, photographs, videos, graphics, logos, names, icons, designs, layout, and other materials—are owned by or licensed to Estancia Tanamá Inc. and are protected by applicable copyright, trademark, and other intellectual property laws.

You may view and use the Site for personal and noncommercial purposes.

Without our prior written permission, you may not:

Copy, reproduce, modify, republish, distribute, sell, or commercially exploit Site content;
Remove copyright, trademark, or ownership notices;
Use our name, logo, photographs, or branding in a way that suggests sponsorship or endorsement; or
Use photographs or information about animals in our care for fundraising, solicitation, advertising, or commercial purposes.

You may share links to publicly available Site pages and social media posts, provided that you do not alter the content or falsely suggest that Estancia Tanamá endorses you, your organization, or your activities.

Third-Party Services and Links

The Site may contain links to or integrations with third-party websites and services, including payment processors, donation platforms, shipping carriers, social media services, email providers, and merchandise fulfillment providers.

Third parties operate under their own terms, privacy policies, and practices. We do not control and are not responsible for the availability, security, content, products, or practices of third-party services.

A link to a third-party website does not necessarily mean that we endorse that website or everything it offers.

Site Availability and Changes

We may update, change, suspend, restrict, or discontinue any part of the Site at any time.

We do not guarantee that the Site or any particular feature, form, product, or service will always be available, uninterrupted, secure, or error-free.

We may correct errors, inaccuracies, or omissions without prior notice.

Disclaimers

The Site and its content are provided on an “as is” and “as available” basis to the fullest extent permitted by applicable law.

We make no express or implied warranties regarding the Site, including warranties of accuracy, availability, merchantability, fitness for a particular purpose, title, or non-infringement.

We do not guarantee that:

The Site will always operate without interruption or error;
Defects will always be corrected;
The Site or its servers will be free from viruses or harmful components; or
Information on the Site will always be complete, current, or accurate.

Information provided through the Site is for general informational purposes only. It is not veterinary, medical, legal, tax, financial, or other professional advice.

For an animal emergency or health concern, contact a licensed veterinarian or the appropriate local emergency service.

Limitation of Liability

To the fullest extent permitted by applicable law, Estancia Tanamá Inc. and its directors, officers, employees, volunteers, contractors, representatives, and affiliates will not be liable for indirect, incidental, special, punitive, exemplary, or consequential damages arising from or related to:

Your access to or use of the Site;
Your inability to access or use the Site;
Reliance on information available through the Site;
Third-party websites, services, payment processors, or carriers;
Unauthorized access to information despite reasonable safeguards; or
Merchandise purchased through the Site.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

Indemnification

To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Estancia Tanamá Inc. and its directors, officers, employees, volunteers, contractors, representatives, and affiliates from claims, liabilities, damages, losses, and reasonable expenses arising from:

Your unlawful or improper use of the Site;
Your violation of these Terms;
Information or content you submit;
Your violation of another person’s rights; or
Fraudulent or unauthorized activity associated with your use of the Site.

Governing Law and Venue

These Terms are governed by the laws of the Commonwealth of Puerto Rico and applicable United States federal law, without regard to conflict-of-law principles.

To the extent permitted by applicable law, any legal proceeding arising from these Terms or your use of the Site must be brought in a court with appropriate jurisdiction located in Puerto Rico.

Severability

If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be enforced to the greatest extent permitted by law. The remaining provisions will remain in effect.

No Waiver

Our failure to enforce any provision of these Terms does not waive our right to enforce that provision or any other provision later.

Entire Agreement

These Terms, together with our Privacy Policy and any policies or terms displayed during a donation, purchase, application, or other transaction, constitute the entire agreement between you and Estancia Tanamá Inc. regarding your use of the Site.

Changes to These Terms

We may update these Terms from time to time to reflect changes to the Site, our practices, or applicable legal requirements.

When changes are made, we will post the updated Terms on this page and revise the effective date. Your continued use of the Site after the updated Terms become effective means that you accept the revised Terms.

Changes will not retroactively alter the terms that applied to a completed transaction unless required by law or agreed to by the parties.
